These terms govern the use of the website philosophale.fr and the tools made available by Philosophale SAS as part of its social media management services.
PHILOSOPHALE, a French simplified joint-stock company with a share capital of 100 euros, registered with the Paris Trade and Companies Register under number 984 852 228, with its registered office at 229 rue Saint-Honore, 75001 Paris, France, represented by its President, Arnaud Gosset. Philosophale is a social media management agency. For each client, we prepare content, have it approved, then publish it on the Facebook and Instagram accounts the client has explicitly authorized us to manage, and we report back on the results. The precise scope of each engagement (content, frequency, duration, pricing) is set out in the individual service agreement signed with each client; these general terms do not replace it.
The client remains the sole owner and is solely responsible for their Facebook and Instagram accounts. Philosophale only acts on these accounts within the scope of the authorization the client has granted, and solely to perform the agreed service.
Unless otherwise agreed in the service agreement, content published on a client's behalf (text, visuals, videos) becomes their property upon publication on their accounts.
Philosophale commits to a best-efforts obligation in managing the publications entrusted to it. Philosophale cannot be held liable for moderation, restriction, or service interruption decisions made by Meta (Facebook, Instagram), nor for outages of their platforms, which are outside its control.
Each service agreement may be terminated according to its own terms. At the end of the contractual relationship, Philosophale's access to the client's accounts is revoked and the associated data is deleted in accordance with our privacy policy.
These terms are governed by French law. Any dispute falls under the jurisdiction of the courts of Paris.
